California Privacy Notice

WHAT IS THE SCOPE OF THIS PRIVACY NOTICE?

This California Privacy Notice (“Privacy Notice”) supplements the information contained in Razor’s Privacy Policy and applies solely individual residents of the state of California (“California Consumer”).

This Privacy Notice sets forth how Razor USA and its affiliated entities (referred to collectively as “Razor,” “We,” “Our,” or “Us”) collect, use, disclose and process the personal information of California Consumers, either online or offline, within the scope of the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (“CCPA”).

As used in this Privacy Notice, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. Personal Information may include, but is not limited to, the categories of Personal Information identified below.  For purposes of this Privacy Notice, Personal Information does not include information relating to job applicants, employees, contractors or other Razor personnel.

INFORMATION WE COLLECT AND RETENTION PERIODS

We may collect the following categories of Personal Information from You in a variety of different situations, including but not limited to on Our Websites, Your mobile device, through Your email, through the mail, through the telephone, when You submit an online form, when You contact customer service and/or when You fill out a survey or contest application.

  • Contact Information – such as information that You provide for the purpose of registering for a user account, requesting customer support, or filling out a form made available on the Website (g., first and last name, email address, phone number, mobile phone number, mailing address).
  • Online Identifiers – such as Your account username and password.
  • Payment and Commercial Information – such as information You provide in connection with ordering or purchase transactions, including products purchased or considered, and shipping information for order fulfillment. Our Website uses PayPal Payflow Gateway and TSYS to process payments made by debit or credit card for transactions on the Website, and installment financing plans for Website purchases may be available through quadpay.  Razor does not collect, process or store any payment card information or financing information provided by You on Our Website.  You should consult  PayPal’s, TSYS’s, or quadpay’s privacy policies for further information about their data collection and privacy practices for this information.
  • Computer, Internet and Network Activity Information – such as information obtained from Your use of the Website (g., Your server log information, queries or searches, browsing history, internet protocol address, unique device identifiers, and mobile network information).
  • Employment and Education Information – such as information You submit to Us in connection with an application for employment, including Your resume, job history, and, in some cases, performance evaluations. In addition, certain demographic information may be collected about employees for regulatory reporting and compliance purposes (e.g., gender, race, and ethnicity).
  • Customer Support Information – if You call Our customer support representatives, the conversation may be recorded and retained for quality assurance and training purposes. We also retain all written communications with customer support representatives, including emails, texts, and online forms.
  • Geolocation Information – such as non-specific geolocation information to identify nearby Razor service centers.
  • Other information – such as information from any communications with Us and other user-generated content submitted by You or on Your behalf to Us through e-mail or other means (e.g., text, images, audio, video or other content that You create).
  • Marketing and promotional information – such as information You provide for the purpose of enrolling or participating in any programs, promotions or contests offered by Razor.

We store these categories of the Personal Information for no longer than necessary for Our legitimate business and commercial purposes and interests, or as required by or permitted by applicable law.

HOW DOES RAZOR USE THE INFORMATION IT RECIEVES?

Razor, on its own or through authorized service providers, contractors and third parties may use Your personal information that You provide to Us or that is collected about You for Our legitimate business or commercial purposes, including:

  • To administer the Website and present the Website and its contents to You, as well as to facilitate and improve Your experience on the Website;
  • To process Your registration and manage Your online account;
  • To personalize the Website for You;
  • To help enable Your access to use the Website and its services;
  • To provides You with products and conducts transactions (including purchases and returns);
  • To process payment;
  • To process, fulfill, and ship purchase requests, and complete returns and exchanges;
  • For advertising, promotional and marketing communications, including direct mail and direct email, and process promotions, surveys, contests, giveaways, sweepstakes, and related prizes or incentives

  • To the extent required by law, in connection with any legal proceedings or prospective legal proceedings, and in order to establish, exercise, or defend Razor’s legal rights.
  • In connection with negotiations for or any actual sale, acquisition or transfer all or a portion of Our business or assets.

DISCLOSURES OF PERSONAL INFORMATION FOR A BUSINESS OR COMMERCIAL PURPOSE

Razor has disclosed the categories of Personal Information described in the “Information We Collect and Retention Periods” section above for Our legitimate business or commercial purposes (listed immediately above) to Our authorized service providers, contractors and  third parties.  In addition, Razor may disclose or share Contact Information, Computer, Internet and Network Activity, Other Electronic Information, and Marketing and Promotional Information for marketing or advertising purposes to authorized third party marketing and advertising companies and social media companies as described below.

DOES RAZOR “SELL” OR “SHARE” YOUR PERSONAL INFORMATION?

Razor does not sell Your Personal Information in exchange for money.  We may share (as defined by the CCPA) some of Your Personal Information in order to provide You with personalized advertising as described below.

INTEREST BASED OR TARGETED ADVERTISING DISCLOSURE

We use authorized third party advertising companies to place Our ads on other websites.  One way We do so is by allowing network advertising companies and social media networks (“Network Advertisers”) with which We work to place their own cookies on the browser of an individual who visits one or more of Our Websites and who clicks “accept” on the cookie consent banner on the site.  This enables these Network Advertisers to place a cookie on Your computer and to receive information (including, for example, Your IP Address, internet tracking data, and advertising IDs) from that cookie that may include information about Your visits to this and other websites.  This data received by Network Advertisers allows them to measure advertising effectiveness and to provide advertisements on other websites about Our goods and services that are tailored to You and that may be of interest to You.  These Network Advertisers may in turn disclose Your cookie data to other network advertisers to allow these advertisers to display ads to You as well.

If You would like to delete the cookies We set in Your browser, You may visit the “Help” section of Your browser, which may contain that information.  You may also be able to opt out of receiving targeted advertising from members of the National Advertising Initiative (NAI) by clicking the “Ad Options” icon on the advertisements or by going to www.networkadvertising.org.  In addition, the Digital Advertising Alliance maintains a website where consumers can opt out from receiving interest-based advertising from some of or all the network advertising companies participating in the program – www.AboutAds.info/choices or https://youradchoices.com/control.

WHAT ARE YOUR PRIVACY CHOICES?

If You are a California Consumer, You may be able to exercise the following rights:

  • Right to Know: The right to request information about the specific personal information collected about You (typically for the 12 month period preceding Your request);
  • Right to Delete: The right to have Your personal information deleted (subject to certain exceptions);
  • Right to Correct: The right to request correction of inaccurate personal information;
  • Right to Know About Sale or Sharing: The right to request disclosure of the categories of Your personal Information sold/shared and the categories of third parties receiving that information;
  • Right to Opt-out of Sale or Sharing: The right to direct that Your personal information not be sold to or shared with third parties for cross-context behavioral advertising; and
  • Right to Non-Discrimination: The right not to be discriminated against because You exercised any of these rights.

HOW TO EXERCISE YOUR PRIVACY CHOICES

To exercise any of these rights (other than non-discrimination), You can contact Us at [email protected] or by going to Our About Us page to submit an electronic contact form (“Contact Form”).  The Contact Form requires You to complete several mandatory fields (name, email address, etc.).  Under the “You’re Reaching Out About” section, please select “Privacy Policy Questions.”

Once You submit a completed Contact Form, Razor will proceed to verify that the person making the request is the California Consumer about whom We have collected Personal Information.  If We are able to successfully validate Your identity, We will respond to Your request within the time and in the manner required by CCPA.  If We cannot validate Your identity, We will attempt to contact You to inform You of this issue.

If You would like to opt-out of the sharing of Your personal information by Razor with third parties, You can click on the link entitled Do Not Sell or Share My Personal Information.

There may be certain circumstances when We may not completely fulfill Your request, as permitted under the CCPA. For example, in connection with a Request to Delete, We may need to retain certain information to complete a transaction, detect fraud, or comply with a legal obligation.

In certain circumstances, You are permitted to designate an authorized agent (as defined in the CCPA) to submit requests on Your behalf.  We may require additional information in order to verify the authorized agent’s authority to act on You behalf.
